Sarina Cheung is a consultant and the head of probate and succession planning in the global private wealth and family office practice of Eric Chow & Co. in Association with Commerce and Finance Law Offices.
Sarina specialises in wills and probate, trust management, mental health law, and litigation. Her expertise encompasses both contentious and non-contentious trust and probate matters, along with succession and wealth planning.
Prior to joining Commerce & Finance, Sarina was a consultant at an independent local firm for 2 years and spent 3 years at a leading international law firm. Her extensive hands-on experience in the private banking sector includes 11 years as the head of the probate services department at a well-established trust and banking corporation in Hong Kong.

Contentious Trust and Probate
- Advised a beneficiary of a HK$30billion estate against executrix for mal-administration and family members for misappropriation of funds shortly prior to the death of Deceased
- Advised the brother and nephew of a deceased who is the female member of New Territories Indigenous inhabitants, challenging the Will for violation of traditional indigenous village rules
- Advised the administrator of an estate and the underlying companies of the Estate to i) defend claims against the Estate on debts due; ii) claim against nominee shareholder for shares that should form part of the Estate; iii) claim against ex-company directors for breach of directors duties re operating company held by the Estate
- Advised the legitimate daughters of a renowned businessman i) against the claims of two illegitimate daughters; ii) claim against the father’s estate for unlawful transfers from the mother’s estate (who predeceased the father)
- Advised clients on the revocation of a Grant of Probate, which was wrongfully issued based on a revoked Will
- Advised a mother to ascertain the rights of her illegitimate child over the estates of his late father against an estranged but not divorced spouse
- Advised a client regarding a Grant application by conservators of one of the residuary beneficiaries who is a mentally incapacitated person
- Advised a client on her financial claims pursuant to Inheritance (Provision for Family and Dependents) Ordinance (Cap. 481) against the estates of a wealthy tycoon who was a beneficiary of a substantial family trust
- Advised the trustee of a trust which was one of the residuary beneficiaries in a claim brought by the beneficiaries of a complex estate against the executors for breach of fiduciary duties
- Advised on a case involving a fixed trust and a discretionary trust under Cayman Law, with the same settlor. The dispute concerned whether "issue," as defined in the trust deed, includes the illegitimate children of the settlor
Mental Health Law
- Advised a client on a contentious committeeship application under Part II Mental Health Ordinance. The elderly involved is a renowned philanthropist in Hong Kong, the family of the MIP is divided into two camps and is in dispute over the mental capacity of the elderly
- Advised a client on a contentious committeeship application under Part II Mental Health Ordinance. The MIP is residing in Hong Kong with his second wife while his daughter from first marriage resides overseas. Suspicious assets transactions were discovered, and steps were taken to mitigate potential asset dissipation
- Advised the parents of a mentally incapacitated person to sought guardian over the spouse who refused to consent to his medical treatment without the parents fulfilling her financial requests
- Advised a client who was appointed as an attorney under an Enduring Power of Attorney to rectify any potential breach of his duties
- Advised a client for a Statutory Will to be executed, expeditiously and within 3 months, on behalf of the mentally incapacitated person. Strategic advice was given to resolve potential opposition to ensure the application went smoothly
- Advised a single mother to set up a trust for her adult child with severe autism. The mother was approaching retirement and was concerned about the financial well-being of her daughter upon her own demise
Non-contentious Probate
- Advised the grant application for a deceased individual domiciled in Singapore who died intestate. The estate included valuable real estate properties in Hong Kong under leases. Assisted in applying for a Grant Ad Colligenda Bona to collect rent and renew leases and conducted a Rule 29(c) application for a Grant of Letters of Administration
- Advised UK beneficiaries in execution of a Deed of Variation to vary their entitlement for succession purposes. The deceased was the sole beneficiary of her husband’s estate, who passed away one month before she died. Sarina assisted in the appointment of an executor of the husband’s estate who was also appointed as a substitute administrator for wife’s estate
- Advised the executor to negotiate with the UK Tax authority to substantially reduce the worldwide IHT on the deceased’s assets situated in four jurisdictions and beneficiaries from four jurisdictions consisting of individuals, local and oversea charities
- Advised the family of a deceased to apply to Court for leave to probate a copy Will as the Original Will was lost
Wealth and Succession Planning
- Advised clients on succession planning and wealth planning to cater for their life issues. Sarina works closely with the family team to offer strategic advice on the structure of the planning from litigation perspective
